1. Introduction

These Terms & Conditions (“Terms”) govern access to and use of this website and platform (“MyCreatorJobs”).

By using the Platform, you agree to these Terms.

The Platform provides an online marketplace that enables independent service providers (“Providers”) and clients (“Clients”) to connect and arrange services directly with one another.

2. Nature of the Platform

The Platform operates solely as an online marketplace and intermediary technology service.

The Platform:

• does not employ Providers;

• does not supply workers to Clients;

• does not supervise or control the performance of services;

• is not a party to agreements between Clients and Providers unless expressly stated otherwise.

Providers operate as independent self-employed contractors.

Nothing in these Terms creates:

• an employment relationship;

• worker status;

• a partnership;

• a joint venture;

• or an agency relationship

between the Platform and any Provider or Client.

3. Independent Contractor Status

Providers acknowledge and agree that they:

• are self-employed independent contractors;

• are responsible for their own taxes, insurance, licences, and legal obligations;

• may determine whether to accept or reject work opportunities;

• may provide services to other businesses or clients;

• control how services are performed unless otherwise agreed directly with Clients.

Providers are solely responsible for complying with applicable laws relating to self-employment and taxation.

4. Client and Provider Agreements

Any agreement for services is made directly between the Client and the Provider.

The Platform is not responsible for:

• the quality, legality, safety, or delivery of services;

• disputes between users;

• representations made by Clients or Providers.

Users acknowledge that the Platform does not guarantee:

• availability of work;

• minimum earnings;

• continuous access to opportunities;

• suitability of Clients or Providers.

5. Payments

The Platform may facilitate payments between users.

Where payment processing services are used:

• the Platform acts only as a payment facilitator or intermediary;

• payment processing may be handled by third-party providers.

Providers remain responsible for:

• invoicing obligations;

• taxes;

• VAT obligations;

• accounting requirements.

6. User Conduct

Users must not:

• provide false information;

• engage in unlawful activity;

• infringe intellectual property rights;

• harass or abuse other users;

• misuse the Platform.

The Platform reserves the right to suspend or terminate accounts at its discretion.

7. No Guarantee of Employment

Use of the Platform does not guarantee:

• employment;

• worker rights;

• engagements;

• assignments;

• or income.

The Platform does not operate as an employer of Providers.

8. Limitation of Liability

To the fullest extent permitted by law, the Platform shall not be liable for:

• indirect or consequential losses;

• loss of profits;

• disputes between users;

• service interruptions;

• actions or omissions of Clients or Providers.

Total liability shall not exceed the fees paid to the Platform in the preceding 12 months.

9. Indemnity

Users agree to indemnify and hold harmless the Platform against claims arising from:

• breach of these Terms;

• services provided or received;

• tax or employment-related claims;

• unlawful conduct.

10. Intellectual Property

All Platform content, branding, software, and design remain the property of the Platform unless otherwise stated.

Users may not copy or reproduce Platform materials without permission.

11. Privacy

Use of the Platform is also governed by the Privacy Policy.

12. Changes to Terms

The Platform may update these Terms at any time.

Continued use of the Platform constitutes acceptance of revised Terms.

13. Governing Law

These Terms shall be governed by the laws of England and Wales.

Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
